and Conditions
Your use (accessing, browsing, shopping,
etc.) of this site is your legal agreement to the policies, terms
and conditions below. These terms and conditions are subject to
change without prior notice at any time. By visiting, browsing,
shopping, accessing or otherwise using the Site after a change has
been posted to the Site, the Customer accepts that change.
Product Availability & Pricing
Due to the fast-moving nature of the computing
industry, prices, promotions and product availability are subject
to change without notice. We do our best to provide the most accurate,
up-to-date information, but errors do occur and we reserve the right
to make changes without notice. If you have ordered a product that
is subject to a price increase, we will hold your order and inform
with you of the increase.
Actnetonline.com products, prices, availability
and payment methods may vary from Actnet retail store. Published
prices do not include shipping, handling, sales tax and insurance.
Changes
Pricing, product availability and offers
are subject to change without prior notice. We reserve the right
to make changes without notice due to market conditions, manufacturer
or supplier product discontinuation, or typographical, photographic
or technical errors in online or print advertising. Product and
packaging depicted may differ from stock available at time of shipment.
We reserve the right to substitute equivalent items.
Shipping Options & Policies
Continental U.S. Shipments
All orders will be shipped via UPS ground
transportation within the 48 continental states for a minimum shipping,
handling and insurance of $5.59. Other shipping options are available
upon request. Please specify your shipping preference via e-mail
us or call (415)661-9000 between 9:00 a.m. and 6:00 p.m. PST, Monday
through Saturday. We will confirm your order and provide your shipping
charges. For the Customer's protection, we ship only to an address
that can be verified according to our standards.
International Shipments
We will gladly ship internationally,
unless shipments are restricted by law. To determine eligibility
for international shipping, please e-mail us or call (415)661-9000
between 9:00 a.m. and 6:00 p.m. PST, Monday through Saturday. We
will promptly send an e-mail to you to both confirm your order and
provide your shipping charges. Please remember that all customs
clearing, duties and taxes are not included in the freight calculation
and are the responsibility of the customer. Manufacturer's limited
warranties for internationally shipped products may vary or be null
and void.
(NOTE: Shipments that are not retrieved from customs are
not covered by our insurance.)
Export
To comply with certain vendor agreements
and government regulations, Actnet reserves the right to refuse
to export products from the United States at any time. If you are
purchasing products for export, you are responsible for the necessary
export documentation before shipment is made to a foreign country.
Manufacturer's warranties for exported products may vary or be null
and void.
Signature
For your protection, all shipments require
a signature at the delivery point.
Late or Delayed Shipments
Title to items being purchased is retained
by Actnet until said items are paid for by the purchaser, and title
passes to purchaser at that time. Customer takes on full liability
for safety and validity of delivery address given to us at the time
of purchase. Actnet will not incur any forwarding costs on shipments.
Invoice & Order Acceptance Policy
Your receipt of an electronic or other
form of order confirmation does not signify our acceptance of your
order, nor does it constitute confirmation of our offer to sell.
Actnet may change its pricing, product description or specification
after any order confirmation or response e-mail but prior to shipment
due to errors, changing market conditions, product discontinuation
or unavailability, typographical errors, or any other reason.
Actnet reserves the right at any time
after receipt of your order, without prior notice to you, to supply
less than the quantity you ordered of any item. We may require additional
verifications or information before accepting any order. We will
notify you of any corrections or changes and ask for your approval
before we complete your order. We will not complete your order until
we have your approval. All products
are subject to our stock availability.
Payment Methods
We accept Visa, MasterCard, American
Express, Paypal, Wire Transfer and Cashier’s check. We do
not add any credit card surcharges. Please see our Privacy and Security
Statement for more information about your credit card safety. To
avoid delays with your order, please provide us with correct credit
billing address. We do verify all billing addresses. Address which
cannot be verified will be canceled. If your shipping address is
different from your billing address, Actnet requires that this address
be listed on your credit card account as an alternate address for
shipping purposes only. You can contact your credit card company
by calling the 1-800 number on the back of your credit card. Actnet
requires this in order to protect our customers from credit card
fraud. We also accept Government,
Educational, and approved Corporation purchase orders. If you are
first time customer and like to apply for credit, please call us
at (415)661-9000 or email us at service@actnetonline.com to pre-qualify.
No personal checks or business checks will be accepted without prior
approval. Due to our rapid inventory turnover, payments must be
received within 14 days, or your order may be canceled.
Tax Exemption
Actnetonline.com is required by
law to collect sales tax for purchases made at Actnetonline.com
to all California residents at 8.5% tax rate. If
you are a reseller or a tax exempt organization, please call us
at (415)661-9000 to pre-qualify. You will need to fax us the Reseller’s
Permit, or your tax exempt certificate to (415)661-9016. For your
convenience, your information will be kept on file for future purchases.
Returns Policies
and Procedure
Procedure
Please fill out service request
on the website to obtain a Return Merchandise Authorization (RMA)
number before shipping your product. NO returns of any type will
be accepted without a RMA number. RMA numbers are valid for 10 business
days after issue and must be received in our warehouse within 20
days from the date of the invoice. Any returns will be refunded
the lower of either the purchase price or current product price.
For faster service, please have the following
information on hand when requesting an RMA number: customer name,
email address, invoice/order number, and serial number (if applicable),
and nature of the problem.
Your RMA number(s) must appear clearly
on the shipping label on the outside of the return shipment. An
RMA label will be provided in the confirmation email after your
RMA is being processed. Print the form, fill it out and tape it
on the box you are returning. Please do not mark the box itself
in any other way.
We are not responsible for lost or stolen
packages. All authorized returns must include a shipment tracking
number. Subsequent to an approval authorization, a credit to an
account or issuance of a check may take up to 30 days.
Returns must be 100% complete, in original
and resalable condition, with all original boxes and packing materials,
have original UPC codes on the manufacturer boxes, contain all manuals,
registration card(s), software, cabling and accessories. We reserve
the right to refuse a return on any product that does not meet these
requirements.
The Customer is responsible for shipping
charges on all returned items.
Actnet strongly recommends that you fully
insure your return shipment in case it is lost or damaged and use
a carrier that can provide you with proof of delivery for your protection.
Restocking Charge
Any returned products must be complete
in manufacturer’s packaging with all accessories and UPC codes.
If an incomplete product is returned, then we'll assess a minimum
20% restock fee in addition to any charge imposed prior to the return.
Missing UPC codes will result in a restock fee that may match any
existing manufacturer rebates on the product requiring UPC codes.
Defective products
Defective products will be accepted for
credit, replacement, exchange or repair, at our discretion, within
30 days from the invoice date. Our technical support department
prior to issuing a return authorization must deem a product defective.
Manufacturer restrictions do apply and are outlined in our return
policy. Terms of the manufacturer's warranty apply from day one.
Non-defective products will be issued
a return authorization within 30 days from the invoice date at Actnet’s
discretion. All non-defective returns are subject to 20 percent
restocking fee. Shipping charges are not refundable. We cannot accept
unauthorized shipments billed to the recipient.
If merchandise arrives damaged, it is
best to refuse it back to the carrier attempting delivery. If you
accept the package make sure it is noted on the carrier’s
delivery record in order for Actnet to file a damage claim. Save
the merchandise in the original box and packing it arrived in, notify
Actnet immediately to arrange for a carrier inspection and pick
up of damaged merchandise. If you do not notify Actnet of damaged
goods within the first 15 days of arrival, our regular return policy
will override any claim of damage, and will fall under all current
manufacturer restrictions. Fill out a service request form online
or call (415)661-9000 to arrange for carrier inspection and a pick
up of damaged merchandise.
A minimum restock fee of 20% may be applied
to products returned as defective that test to be operational upon
return.
Non-returnable Products
ALL CLEARANCE PRODUCTS (INCLUDING REFURBISHED,
NEW AND OPEN BOX ITEMS) PURCHASED FROM THIS WEBSITE CANNOT BE RETURNED.
Driver CDs and manuals may not be included
with the products, but you may be able to order missing disks from
the manufacturer (additional fees may apply).
Software
Unopened software may be returned for
refund or exchange within 30 days of invoice date. Open box software
is non-returnable. The customer assumes responsibility for verifying
compatibility of software as printed on manufacturing package.
In some cases the manufacturer prefers
to handle the exchange of defective product and the customer needs
to contact the manufacturer directly. Macromedia (1.800.470-7211),
Microsoft (1.800.936-5600) and Quark (1.303.894-8888) are examples
of manufacturers who will handle the defective returns themselves.
Licensing
The Actnet Licensing Manager must
approve all licensing returns. Generally, all licensing sales are
final. However, many software vendors will allow exception returns
within the first 30 days. In some cases, a replacement order is
required. For more details, contact your sales associate.
Governing Law
Transactions between you and Actnet
shall be governed by and construed in accordance with the laws of
the State of California without regard to the laws regarding conflicts
of law. If any provision of this agreement shall be unlawful, void,
or for any reason unenforceable, then that provision shall be deemed
severable from this agreement and shall not affect the validity
and enforceability of any remaining provisions.
This agreement, the policies printed
on the Actnetonline.com Web site, and the policies, terms and conditions
stated on the applicable Actnet invoice or packing slip, constitute
the entire agreement between the parties relating to the subject
matter herein, and cannot be modified except in a written agreement
signed by both parties.
Typographic, Photographic and Technical
Errors
Although we do our best to achieve
100% accuracy, occasionally errors and inaccuracies do occur. Should
you encounter an error or inaccuracy, please inform us so it can
be corrected.
Warranty Disclaimer and Limitation
of Liability
Actnet explicitly disclaims all
expressed or implied warranties, including any implied warranty
of merchantability or fitness for a particular purpose. Actnet shall
have no liability to anyone for incidental or consequential damages,
or any other liability, loss or damage arising out of or related
to purchases, even if Actnet or an authorized representative of
Actnet has been advised of the possibility of such damages.
All merchandise is sold AS IS. Actnet
makes no warranty as to the performance of any merchandise sold.
We are not responsible for system downtime, lost data, etc. Actnet
does not warrant that the functions contained in any product sold
will be uninterrupted or error-free, or that defects will be corrected,
or that this Web site or the server that makes it available are
free of viruses or other harmful components. Actnet does not warrant
or make any representations regarding the use or the results of
the use of any product purchased in terms of its compatibility,
correctness, accuracy, reliability or otherwise. This disclaimer
by Actnet in no way affects the terms of a manufacturer's warranty,
if any.
You (and not Actnet) assume the entire
cost of all necessary servicing, repair or correction not covered
by manufacturer warranty or additional product protection purchased
from us or a third party on purchases made with our company. In
no event shall Actnet's total liability to you for any and all damages,
losses and causes of action (whether in contract, tort [including,
but not limited to, negligence] or otherwise) exceed the amount
paid by you, if any, to Actnet for the specific merchandise at issue.
Disagreement with These Terms of
Service
If you disagree with any of the
terms and conditions of this User Agreement, please do not visit,
browse, shop, access or otherwise use this Site.
